1. Agreement to Terms

By accessing or using ContractorDash ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

ContractorDash is operated by Digio Gram ("Company," "we," "us," or "our"). These Terms apply to all users of the Service.

2. Description of Service

ContractorDash is a cloud-based ERP platform designed for civil and electrical contractors. The Service provides tools for:

• Site and project management
• GST invoicing and billing
• Manpower tracking and attendance
• Purchase order management
• Reporting and analytics
• Multi-user collaboration

3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information
• Maintain the security of your password
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized use

3.2 Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Subscription and Payment

4.1 Subscription Plans

We offer various subscription plans with different features and pricing. Current plans include Starter, Professional, and Enterprise tiers.

4.2 Billing

• Subscriptions are billed in advance on a monthly, quarterly, or annual basis
• All fees are in Indian Rupees (INR) and include applicable GST
• Payment is due immediately upon subscription
• We use secure third-party payment gateways (Razorpay, Stripe, etc.) for all transactions
• In case of any payment failure or duplicate deduction, the refund/resolution will be handled according to our Refund Policy

4.3 Automatic Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.

4.4 Refund Policy

We offer a 30-day money-back guarantee for new subscriptions. Refund requests must be submitted within 30 days of initial purchase. Refunds are not available for renewals or after the 30-day period.

5. Pricing and Service Modifications

We reserve the right to:

• Modify subscription fees and pricing tiers with at least 30 days' notice to active users
• Update, change, or discontinue any feature or part of the Service at any time
• Implement promotional pricing or temporary discounts at our sole discretion

6. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Violate any laws or regulations
• Infringe on intellectual property rights
• Transmit viruses, malware, or harmful code
• Attempt to gain unauthorized access to the Service
• Interfere with or disrupt the Service
• Use automated systems to access the Service without permission
• Resell or redistribute the Service
• Reverse engineer or decompile the Service

6. Intellectual Property

The Service and its original content, features, and functionality are owned by Digio Gram and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of all data you input into the Service. You grant us a license to use, store, and process your data solely to provide the Service.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy. We implement industry-standard security measures to protect your data, including:

• SSL/TLS encryption for data in transit
• Encrypted storage for sensitive data
• Daily automated backups
• Regular security audits

8. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted access. We may:

• Perform scheduled maintenance with advance notice
• Make emergency updates or repairs
• Modify or discontinue features with notice

9. Limitation of Liability

To the maximum extent permitted by law, Digio Gram shall not be liable for:

• Indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Service interruptions or errors
• Third-party actions or content

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Digio Gram from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

Either party may terminate this agreement:

• You may cancel your subscription at any time from your account settings
• We may terminate for breach of these Terms
• Upon termination, your access will cease and data may be deleted after 90 days

12. Governing Law

These Terms shall be governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

14. Lead Generation and Form Builder Services

The Service includes a "Lead Form Builder" tool to assist you in capturing information from your prospective clients. By using these tools, you agree that:

• You are solely responsible for the content, questions, and processing of data collected via these forms.
• You must comply with all applicable data protection laws when handling lead information.
• ContractorDash is a tool provider and does not guarantee the quality, accuracy, or conversion of any leads generated.
• We reserve the right to remove any form that violates our acceptable use policy.
